The state of Califo
ia is considering reissuing approximately 17,000 commercial driver’s licenses (CDLs) to non-domiciled drivers, amid an ongoing dispute with federal authorities. The Califo
ia Department of Motor Vehicles (DMV) maintains that commercial drivers are a critical pillar of the economy and supply chains, and that the current regulatory uncertainty leaves many eligible drivers without a clear solution.

The controversy stems from disagreements between Califo
ia and the U.S. Department of Transportation (DOT) regarding the validity of CDLs issued to non-domiciled drivers and compliance with federal standards, including English language proficiency. Through the Federal Motor Carrier Safety Administration (FMCSA), the federal gove
ment pushed for an emergency rule aimed at revoking these licenses, citing flaws in the issuance process. However, a legal challenge has delayed its enforcement.

While the rule has not taken effect, Califo
ia argues it can reissue licenses under existing regulations and points out that its CDL holders have fatal accident rates below the national average. State and federal officials continue to hold technical meetings to assess the steps needed toward eventual regulatory compliance.
